O R D E R

This Writ Petition has been filed seeking a direction to the third respondent to issue the Death Certificate of R.Arun Prasad who, died in accident on 02.01.2003.

2. The learned counsel appearing for the petitioner would submit that the petitioner had two sons. The petitioner's husband died and thereafter, her son, namely, Arun Prasad, also died in the accident in the year 2003. Thereafter, the petitioner applied for a legal heirship certificate in respect of her husband. While applying the legal heirship certificate, the officials insisted upon the production of the death certificate of her son, Arun Prasad. Thereafter, the petitioner made an application to the respondents on 21.11.2025 seeking death certificate. However, the respondents have not taken any steps to issue the Death Certificate till date. Hence, the petitioner has filed the present writ petition.

3. The learned Additional Government Pleader appearing for the State would submit that the application filed by the petitioner dated 2/5

21.11.2025 would be considered in accordance with law. He would further submit that the accident involving the petitioner's son occurred within the jurisdiction of Tiruppathur Taluk, whereas the petitioner has submitted her application dated 21.11.2025 before the Tahsildar, Karaikudi.

However, the learned counsel appearing for the petitioner would submit that the petitioner's son was ordinarily residing within the jurisdiction of the Karaikudi Revenue Divisional jurisdiction and therefore, the application has been rightly submitted before the Tahsildar, Karaikudi. It is further submitted that it is the duty of the authorities concerned to conduct a proper enquiry and issue the Death Certificate in accordance with law and that the petitioner need not be directed to approach the Tahsildar, Tiruppathur.

In view of the above, the Tahsildar, Karaikudi Taluk / third respondent is directed to consider the petitioner's application dated 21.11.2025 on merits and in accordance with law, after conducting necessary enquiry and pass appropriate orders within a period of eight weeks from the date of receipt of a copy of this order. 3/5

6. Accordingly, the Writ Petition stands disposed of. There shall be no order as to costs.
