ORDER

The above writ petition has been filed for the following relief:- "Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to directing the 1st to 2nd respondents to settle the amount of policy No. 322297800 to the petitioner and consequential direct to the 1st and 2nd respondents to consider the petitioners representation dated 09.11.2025 and pass such further or other orders as this Honble Court may deem fit and proper in the circumstances of the case and thus render justice."

2. Mr.B.Prasanna Vinoth, learned counsel takes notice on behalf of the respondents.

3. By consent of both the parties, the writ petition is taken up for final disposal at the admission stage itself.

The facts as set out in the affidavit filed in support of the writ petitioner reads as follows:- The petitioner would submit that her mother namely K.Muthulakshmi was a policy holder of the 2nd respondent Branch bearing Policy No.322297800 under "Jeevan Anand Scheme". She would submit that her mother has paid a sum of Rs.4,200/- between 18.03.2008 and 18.02.2024 towards premium to the said policy, for which the petitioner was appointed as a nominee.

While so, in the year 2022, when the petitioner mother was undergoing treatment, the petitioner's mother's third brother viz., 3rd respondent had brainwashed the petitioner's mother's mind and changed his name as a nominee to the above said policy. However, the same had been done without the knowledge of the petitioner. 3/6

7. She would submit that her mother had passed away on 13.10.2025. Subsequent to her mother's death, the petitioner appeared before the 2nd respondent on 04.11.2025 along with Original Policy Bond, the Death Certificate of her Mother and the Legal Heir Certificate to settle the policy amount in her favour. However, the 2nd respondent had refused to settle the same in her favour. Aggrieved by the same, the petitioner has submitted a representation before the 2nd respondent on 09.11.2025 and the same has not been considered to date. Hence, the petitioner is before this Court.

8. Heard the learned counsel on either side.

Considering the facts and circumstances of the case, the respondents are directed to consider the representation of the petitioner dated 09.11.2025 and pass appropriate orders on merits and in accordance with law, within a period of eight (8) weeks from the date of receipt of a copy of this order.

10. The writ petition stands disposed of with the above observations. No costs.
