Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, thereby call for the records of the first respondent order rejecting the petitioner's bid for the works covered in SI.No.2-TRY-45, SI.No.4- TRY-47 and SI.No.5-TRY 48 of tender notice No.20/2025-26, issued by the first respondent and quash the same as illegal and arbitrary and in consequence thereof consider the petitioner's bid as eligible to participate in the above said tender process in all aspects without insisting for the production of work site visit certificate and working condition of plant and machineries certificate from the second respondent and finalize the tender in accordance with law. O R D E R

The present writ petition has been filed challenging the rejection of the technical bid of the petitioner's Company primarily on the ground that the petitioner has not enclosed working condition of Plant and Machineries Certificate.

2. This Court, by an order dated 18.02.2026 has allowed W.P(MD) No. 4037 of 2026 and remitted the matter back to the file of the tender issuing authority to verify and pass orders with regard to the working condition of Plant and Machineries documents submitted by the petitioner.

3. In view of the above said facts, the rejection of technical bid shall be kept in abeyance till a decision is taken by the tender issuing authority with regard to the working condition of the Plant and Machineries Certificate. 3/5

4. With the above said observation, this Writ Petition stands disposed of. There shall be no order as to costs. Consequently connected Miscellaneous Petitions are closed.
