ORDER

This Criminal Original Petition has been filed to transfer the investigation of the case in Crime No.211 of 2019 from the file of the second respondent to the third respondent.

2.The learned counsel appearing for the petitioner submitted that the petitioner's father namely late G.Samuel Nadar had purchased the land comprised in S.No.113/2, measuring an extent of 1 acre 30 cents situated at Sankaraperi Village, Tuticorin Taluk and he was the absolute owner of the property and after the demise of the petitioner's father, the 2/6

petitioner along with four brothers are in possession and enjoyment of the above said property. Thereafter, one person namely, Samuel had created a forged document of power of attorney in the name of Petchiraj and sold the property to many persons including the wife and son of Tamilarasan, who is the Sub Registrar of Pudur. Hence, the petitioner lodged a complaint and the respondent Police registered a case in Crime No.211 of 2019. However, despite registering the FIR in Crime No.211 of 2019, there is no progress in the investigation. Hence, the present Criminal Original Petition came to be filed.

3.Heard the learned counsels on either side and carefully perused the materials available on record.

4.Considering the nature of the dispute involved in this petition, the Deputy Superintendent of Police, Thoothukudi District is directed to take up the investigation directly from the second respondent Police and conclude the same within a period of three months from the date of receipt of a copy of this order.

5.With the above directions, this Criminal Original Petition is disposed of.
