ORDER
1. This Criminal Miscellaneous Petition has been filed to modify the paragraph 21 of the order, dated 12.11.2025, passed in Crl.RC(MD)No.1308 of 2025.
2. This court heard Mr.S.Balaji, the learned counsel for the Petitioner and Mr.Karunanithi, the learned Government Advocate for the Respondent.
3. The learned counsel for the Petitioner submits that this Court, vide order dated 12.11.2025, in Crl.RC(MD)No.1308 of 2025, had released the vehicle in question, with the following condition in paragraph 21:- "21.The learned Principal Special Judge for Narcotic Drugs and Psychotropic Substances Act, Cases, Madurai, is directed to release the vehicle in question forthwith in favour of the Revision Petitioner. The Revision Petitioner is directed to give a bank guarantee of Rs. 20,000/~ (Rupees Twenty Thousand only) before the said Court and file a bond that he shall be producing the vehicle in question as and when needed by the concerned Court and he shall not make any changes nor any variation in the vehicle in question."

The learned counsel for the Petitioner further submits that the paragraph 21 of the order dated 12.11.2025, in Crl.RC(MD)No.1308 of 2025 may be modified to the extent that the Petitioner may be permitted to deposit the sum of Rs.20,000/- by way of a demand draft or cash before the Principal Special Judge for Narcotic Drugs and Psychotropic Substances Act, Madurai, in Cr.No.884 of 2025, within a time frame, instead of furnishing a bank guarantee for the said sum.

Considering the said submissions of the learned counsel for the Petitioner, the paragraph 21 of the order dated 12.11.2025, in Crl.RC(MD)No.1308 of 2025 alone is modified as under:- "21.The learned Principal Special Judge for Narcotic Drugs and Psychotropic Substances Act, Cases, Madurai, is directed to release the vehicle in question forthwith in favour of the Revision Petitioner. The Revision Petitioner is directed to deposit a sum Rs. 20,000/~ (Rupees Twenty Thousand only) by way of a demand draft or cash before the said Court in Crime No.884 of 2025 and file a bond that he shall be producing the vehicle in question as and when needed by the concerned Court and he shall not make any changes nor any variation in the vehicle in question, within a
period of four weeks from today."
6. Except the paragraph 21 of the order dated 12.11.2025, in Crl.RC(MD)No. 1308 of 2025, all other paragraphs of the said order shall remain unaltered.
7. This Criminal Miscellaneous Petition is ordered accordingly, with the above said modification.
8. Let a copy of this order be sent to the learned Principal Special Judge for Narcotic Durgs and Psychotropic Substances Act, Cases, Madurai, for its compliance and information by the Registry of this Court, within two weeks from today.
