Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified mandamus calling for the entire records connected with the minutes of the meeting held on 25.10.2025 held under the chairmanship of the first respondent, order dated 21.11.2025 in Ref.No.90288/N1/2025 issued by the second respondent and the Relieving Order (Deputation) in Ref.No.21429/E2/2/ 2025 dated 25.11.2025 issued by the third respondent and quash the same as illegal in so far as the petitioner is concerned, consequently directing the respondents to permit the petitioner to continue her service in third respondent hospital.

ORDER

This writ petition has been filed challenging the letter No.efile/9659/AA1/2025, dated 24.10.2025 whereby, the minutes of meeting held on 22.10.2025 has been recorded and the consequential proceedings dated 21.11.2025 and 25.11.2025 issued by the Respondents 2 and 3 respectively, whereby cancelling the various deputation orders issued in favour of various candidates, including the petitioner and relieving the petitioner from the Government, Rajaji Hospital, Madurai and requiring the petitioner to join at Government Hospital for Thoracic Medicine, Tambaram.

From the perusal of the impugned orders, it is noticed that the petitioner herein who was originally working at Government Hospital for Thoracic Medicine, Tambaram was deputed to work at Government Rajaji Hospital, Madurai, through proceedings dated 16.02.2016. The petitioner has been working at Madurai since then. Pursuant to a decision taken by the Government, all the deputation orders issued in favour of various 17 candidates, including the petitioner herein were 3/8

cancelled and they were asked to report back to their parent institution. Aggrieved by the said proceedings, the petitioner approached this Court by filing the present writ petition.

3. It is settled law that no employee can claim to be deputed as a matter of right. As seen from the material on record, it is on the request for the petitioner, she has been deputed to Government Rajaji Hospital, Madurai and petitioner has been working for the past 10 years at Madurai and now the said deputation orders are cancelled, in the light of a policy decision taken by the respondent Government. This Court doesn't find any reason to interfere with the said deputation cancellation orders/relieving orders issued by the respondents.

Insofar as the contention of the learned counsel for the petitioner on the ground that, several juniors of the petitioner have been considered for transfer and posting at their request while ignoring the claim of the petitioner in spite of the petitioner obtaining orders from this Court in W.P.(MD)No.5461 of 2024 dated 25.09.2024 is concerned, it is 4/8

for the petitioner to pursue the said claim, for posting at her convenient place, either on the ground of spouse or otherwise. But the said claim of the petitioner to post her at a place where her husband is working cannot be a ground to test the validity of the impugned proceedings. In spite of bestowing ample consideration to the contentions raised in the writ petition. This Court does not find any error or illegality in the impugned proceedings.

5. In the light of the above, this Court is not inclined to interfere with the impugned proceedings. In the light of the request made by the learned counsel for the petitioner, the Registry is directed to return the original relieving order dated 25.11.2025 placed at page 21 of the original typed set to the learned counsel for the petitioner forthwith and the 4th respondent is directed to permit the petitioner to report duty pursuant to the relieving order dated 25.11.2025, provided the petitioner reports to duty within a period of one week from the date of receipt of a copy of this order.

6. Accordingly, the writ petition is disposed of subject to above observation. No costs. Consequently, connected miscellaneous petitions are closed.
