PRAYER: Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the respondents to consider the representation dated 09.09.2025 for the premature release having prisoner CT No.5918 within a time frame fixed by this Court.

[Order of the Court was made by G.K.ILANTHIRAIYAN, J.] The prayer in the Writ Petition is to direct the respondents to consider the representation dated 09.09.2025 for the premature release of the petitioner having prisoner CT No.5918 within a time frame fixed by this Court.

2. Heard the learned counsel appearing on either side and perused the materials placed before this Court.

3. The petitioner was convicted by the learned Additional District and Sessions Judge, Srivilliputhur, Virudhunagar District in S.C.No.137 of 2013 for the offence under Section 302 of IPC and sentenced to undergo life imprisonment. Aggrieved by the same, the petitioner filed an appeal before this

Court in Crl.A(MD) No. 83 of 2022 and the conviction was modified by this Court to under Section 304(i) of IPC and sentenced to undergo ten years rigorous imprisonment, therefore the petitioner is not entitled for any premature release.

4. Premature release is only for life convict, hence the representation submitted by the petitioner was considered and the same was rejected on 12.12.2025 by the fourth respondent.

5. Therefore the prayer sought for by the petitioner has been considered and the same was rejected.
