PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of CERTIORARIFIED MANDAMUS to call for the records relating to the respondent online status rejecting the petitioner's application for grant of REV114 Legal heirs certificate made in TN-720251009838 dated 09.10.2025 and quash the same as illegal and consequently directing the Tirunelveli Tahsildar, Tirunelveli District, the respondent herein to issue the Legal heirs certificate in favour of the petitioner and others for the deceased Rama Krishnan Naidu with in a stipulated time that may be fixed by this Court. ORDER

The present writ petition has been filed challenging the order passed by the respondent herein wherein the request of the petitioner for issuance of legal heir certificate for the death of his father has been rejected primarily on the ground that his father had two wives.

2. According to the learned counsel appearing for the writ petitioner, his petitioner's father had married one Chellammal as the first wife and his mother, namely, Pushpam Ammal, as the second wife. According to him, there is no dispute between both the wives or their children. Therefore, the authorities could not have any objection whatsoever to issue legal heir certificate including both the wives' name and their respective children. Therefore, he seeks to quash the order.

3. In view of the submissions made by the petitioner, the order impugned in the writ petition is quashed and the matter is remitted back to the file of the respondent. The respondent shall issue notice to both the wives and their respective children and after hearing them, shall proceed to issue the legal heir certificate. In case, if there is any objection, the parties may be directed to approach the competent civil Court.

4. With the above said observations, this writ petition stands allowed. No costs. Consequently, connected writ miscellaneous petition is also closed. 04.12.2025 NCC : Yes/No Index : Yes/No Internet: Yes/No RJR To The Tahsildar, Taluk Office, Tirunelveli Taluk, Tirunelveli District.
