PRAYER : Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the 2nd respondent to take appropriate action on the petitioner's complaint dated 08.11.2025 as against the 4th and 5th respondents as per the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 within the period stipulated by this Court. ORDER

This Writ Petition has been filed to direct the 2nd respondent to take appropriate action on the petitioner's complaint dated 08.11.2025 as against the 4th and 5th respondents as per the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 within the time period stipulated by this Court.

2. This writ petition is disposed of at the admission stage, after dispensing with the notice on the private respondents.

3. It is the case of the petitioner that she belongs to the Scheduled Caste community and is working as a Bill Collector in the S.P.Pattinam Village 2/6

Panchayat. On 07.11.2025, at about 12.30 p.m., the 4th and 5th respondents approached the petitioner, assaulted her, pushed her down from her chair, and humiliated her by uttering her caste name.

4. With regard to the said incident, the petitioner made a complaint before the 3rd respondent on 07.11.2025. Upon coming to know that the 2nd respondent is the competent authority to conduct an investigation under the provisions of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, she submitted a complaint before the 1st and 2nd respondents on 08.11.2025.

5. On 08.11.2025, at about 6.00 p.m., the 3rd respondent issued a CSR copy in C.S.R.No.155 of 2025 to the petitioner and directed her to approach the 2nd respondent. Accordingly, the petitioner approached the 2nd respondent; however, no action has been taken on the said complaint. Hence, the present petition.

6. Mr.S.S.Manoj, learned Government Advocate (Criminal Side), on instructions, submitted that proper enquiry has been conducted and the petitioner served as a scavenger in the S.P.Pattinam Village Panchayat. Only 3/6

based on the resolution passed by the Grama Saba of the Panchayat, she was transferred and there is no anomaly.

7. Per contra, Mr.V.G.Vallarasu Chezhiyan, learned counsel for the petitioner, submitted that under the SC/ST Act, the enquiry has to be conducted only by the Deputy Superintendent of Police and that no such enquiry has been conducted by the Deputy Superintendent of Police in this regard.

In view of the above, this Court directs the Deputy Superintendent of Police, Thiruvadanai Sub Division, Ramanathapuram District, to conduct an enquiry in this regard in the manner known to law and to conclude the enquiry within a period of three (3) weeks from the date of receipt of a copy of this order.
