O R D E R

The present Writ Petition has been filed seeking for a Mandamus directing the second respondent to cancel the legal heir certificate dated 02.01.2025 issued by the third respondent in favour of the fourth respondent and to issue legal heir certificate to the writ petitioner by considering her representation dated 25.09.2025.

2. A perusal of the records indicate that one Ganesan had passed away on 30.10.2024. The authorities have issued a legal heir certificate under the impugned order dated 02.01.2025, wherein it is mentioned that one Muthurakku is the legally wedded wife of the deceased Ganesan. However, according to the petitioner, she alone is the legally wedded wife of Ganesan and not the said Muthurakku. The petitioner has approached the authorities for cancellation of legal heir certificate. The authorities have passed an order on 30.10.2025 rejecting the request and directing her to approach the competent civil Court. Without challenging the order dated 30.10.2025, the present writ petition has been filed seeking to cancel the legal heir certificate. 2/4

3. The narration of the above said facts will clearly indicate that the petitioner as well as the said Muthurakku are claiming as legally wedded wife of the deceased Ganesan. The issue can be settled only by way of filing suit before the competent civil Court. Therefore, there are no merits in the Writ Petition.

4. Accordingly, this Writ Petition stands dismissed with liberty to the petitioner to approach the competent authority. There shall be no order as to costs.
