O R D E R

The present Writ Petition has been filed seeking to quash the order passed by the first respondent herein, wherein the request of the petitioner for issuance of legal heir certificate has been rejected.

2. One Maruthasamy Nayakkar had passed away on 30.09.2008, leaving behind two sons namely, Dhanushkodi and Gangappan and a daughter by name Balamani. According to the writ petitioner, one of the sons, namely Gangappan is missing for the past 30 years and they are not aware of his whereabouts. When they applied for the Legal Heir Certificate of Maruthasamy Nayakkar, in their application, they have mentioned as Ganagappan had passed away. This has made the authorities to issue the impugned order rejecting the Legal Heir Certificate. Hence, the present Writ Petition.

3. The learned Special Government Pleader appearing for the respondents submitted that whereabouts of Gangappan are not known hence, the authorities cannot mention him as a dead person.

4. Considering the above said facts, the authorities are directed to issue Legal Heir Certificate for the death of Maruthasamy Nayakkar indicating the name of Gangappan as a missing person.

5. With the above said observation, this Writ Petition stands disposed of. There shall be no order as to costs. Consequently connected Miscellaneous Petition stands closed.
