PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus by challenging the impugned order in Moo.Mu.H3/9025/2025 dated 10.09.2025 passed by the 2nd respondent and quash the same as illegal and void and consequently direct the 2nd respondent to retain the legal heir certificate issued in favour of the petitioner. 1/4

ORDER

The present writ petition has been filed seeking to quash the order dated 10.09.2025 passed by the second respondent herein wherein the legal heirship certificate already issued in favour of the writ petitioner has been cancelled.

2. A perusal of the records reveal that the 4th respondent claims to be the first husband of the deceased Precilla Rajakumari. However, the petitioner claims that he is the husband of the deceased Precilla Rajakumari. After the dispute came to the knowledge of the second respondent, he has chosen to cancel the legal heirship certificate which was already issued in favour of the writ petitioner. This cancellation order is put to challenge before this Court.

3. A perusal of the records further reveal that the petitioner has already approached the District Munsif Court, Aravakurichi and filed O.S.No.3 of 2025 in this regard. In such circumstances, this Court does not find any merits in the 2/4

writ petition. It is for the competent civil Court to decide who is the legally wedded husband of the deceased Precilla Rajakumari.
