ORDER
This Writ Petition has been filed to direct the 1st to 4th respondents to take necessary action on the petitioner's complaints dated 11.10.2025 and 12.10.2025.
2. It is the case of the petitioner that the petitioner's gold chain, worth about Rs.5,00,000/-, was stolen by the 5th respondent, who is none other than the wife of the petitioner's sister's son. In this regard, on 11.10.2025, the petitioner made a complaint through registered post to the 1st and 2nd respondents. Thereafter, on 12.10.2025, the petitioner submitted a complaint before the 4th respondent seeking registration of a criminal case against the 5th respondent. Upon receipt of the same, C.S.R.No.556 of 2025 was issued to the petitioner. Thereafter, no action has been taken by respondent Nos.1 to 4. Hence, the present petition.
3. Heard the learned counsel on either side, and perused the materials available on record.

It is needless to point out that whenever a complaint of this nature is made to a Statutory Authority, there is a duty cast upon the respondent to consider the same on its own merits and pass appropriate orders in one way or other instead of keeping the same pending indefinitely. As such, nonconsideration of the complaint made by the Statutory Authority would amount to dereliction of duty and hence, this Court will be justified in invoking the extraordinary powers under Article 226 of the Constitution of India.

Without going into the merits of this case, this Court directs the 4th respondent police to issue summons to both parties concerned within a period of one [1] week from the date of receipt of a copy of this order, conduct an enquiry in the matter pertaining to C.S.R.No.556 of 2025 dated 12.10.2025, and conclude the same within a period of two [2] weeks thereafter.
