For Petitioner : Mr.P.Sureshkumar For Respondents : Mr.S.P.Maharajan Special Government Pleader COMMON ORDER (Order of the Court was made by DR.G.JAYACHANDRAN, J.) These two writ petitioners herein claiming themselves as bona fide purchasers of the subject properties, which is now termed as encroached land and sought to be evicted by virtue of the impugned dated 18.11.2025 issued by the Special Thasildar, Adi Dravidar Welfare, Usilampatti, are before this Court claiming that the land belongs to one Muniyandi Chettiar, from whom they have purchased it in the year 2002 and constructed residential houses, while so, the impugned order has been issued terming them as encroachers and directing them to evict within seven days.

2.The learned Special Government Pleader submitted that the land in dispute is the land acquired by the Adi Dravidar Welfare Department for allotting house sites to the landless Adi Dravidar poor people. After proper notification, the land from Muniyandi Chettiar was acquired vide award dated 29.09.1998 and possession was also taken and 2/5

was allotted to 20 persons, who belong to landless Adi Dravidar community. The petitioners alleged to have purchased the land after acquisition and has no right or title.

3.This Court on verifying the records finding that even if the petitioners have purchased the property for value, they cannot be termed as a bona fide purchasers as their vendor has lost title after acquisition of the land and after passing of the award. Therefore, the petitioners have to work out their remedy elsewhere not by way of writ petitions. 4.The writ petitions stand dismissed. No costs.
