ORDER

This Criminal Original Petition has been filed to direct the learned 1st Additional District Judge (PCR), Trichy, to consider the bail application of the petitioners on the same day of their surrender before that Court in connection with Crime No.409/2025 on the file of the 2nd respondent police.

2. Considering the nature of the relief sought for, notice to the 3rd respondent is dispensed with.

3. The learned counsel for the petitioners submitted that a dispute prevails between the petitioners and the de facto complainant, who belong to the same area and have a pending civil dispute. The de facto complainant alleges the petitioners damaged their agricultural land and assaulted them on 15.11.2025. Hence, the de facto complainant lodged a complaint before the 2nd 2/5

respondent police. Based on these allegations, an FIR has been registered against the petitioner. The petitioners claim the de facto complainant initiated the quarrel, and a counter-case (Crime No. 410/2025) was registered against the de facto complainant and others.

4. Heard the learned counsel on either side and carefully perused the materials available on record.

Considering the limited scope of the relief sought for, this Court hereby direct the learned 1st Additional District Judge (PCR), Trichy, to issue prior notice to the de facto complainant and thereafter to consider the bail application of the petitioners on the same day of their surrender before that Court in connection with Crime No.409 of 2025 on the file of the 2nd respondent police.
