ORDER
This criminal original petition has been filed seeking to quash the order in Crl.R.C.No.1 of 2020 on the file of the learned Principal District Judge, Thoothukudi, dated 20.09.2025 revering the order passed in Cr.M.P.No. 485/2017 in C.C.No.587 of 2017 on the file of the learned Judicial Magistrate No.III, Thoothukudi, dated 04.10.2018 and discharge the petitioner from C.C.No.587 of 2017 on the file of the learned Judicial Magistrate No.III, Thoothukudi.
2.The learned counsel appearing for the petitioner submitted that the impugned order is liable to be set aside as the Bishop of Thoothukudi Nazareth Diocese, himself has given a written communication to the Superintendent of Police, dated 07.03.2007, wherein he has categorically acknowledged that the entire amount of Rs.40 lakhs has been safely deposited in the SSI Provident Fund of the Diocese and hence, it is not necessary to proceed further on the basis of the complaint lodged by him.

3.Heard the learned counsel on either sides and perused the materials available on records.
4.Recording the submission of the learned counsel appearing for the petitioner, the order passed in Crl.R.C.No.1 of 2020 on the file of the learned Principal District Judge, Thoothukudi, dated 20.09.2025 is set aside confirming the order passed in Cr.M.P.No.485/2017 in C.C.No.587 of 2017 on the file of the learned Judicial Magistrate No.III, Thoothukudi, dated 04.10.2018 discharging the petitioner from C.C.No.587 of 2017 on the file of the learned Judicial Magistrate No.III, Thoothukudi. 5.Accordingly, this Criminal Original Petition stands allowed.
