To Condone the delay of 832 days in re presenting the Second Appeal in SA(MD) SR No.58199 of 2023 and thus render justice.

ORDER

The delay of 832 days in re-presenting the Second Appeal papers is sought to be condoned.

2.I have heard Mr.R.R.Kannan, learned Counsel for the petitioner and Mr.R.Thangapandian, learned Counsel for the contesting first respondent. 3.Learned Counsel for the petitioner stated that the delay occasioned only on account of the learned Counsel having shifted the office twice. Meantime, the papers got misplaced and hence, delay occasioned. 4.Though delayed counter affidavit has been filed by the contesting respondent that the delay is unexplained and inordinate, I am satisfied with the reasons assigned for the delay in re-presenting the Second Appeal. At the same time, in order to compensate the prejudice caused to the first respondent, this Civil Miscellaneous Petition is allowed on payment of Rs.2,000/- to the learned Counsel for the first respondent within a period of one [1] week.
