The above petition has been filed seeking orders to restore the petition in CMP(MD)No.13932 of 2024 in CMA(MD)SR No. 59497 of 2024, which was dismissed for non-prosecution, vide order dated 18.11.2024. 2.Heard the learned counsel appearing for the petitioner and the learned counsel appearing for the first respondent.

3.The learned counsel appearing for the first respondent would submit that they are leaving it to the discretion of the Court.

It is seen from the records that the petitioner has filed an application to condone the delay in filing the restoration petition and the same was allowed on 27.02.2026 5.Considering the facts and circumstances of the case and also taking note of the reasons assigned, this Court is inclined to allow this petition. Accordingly, this petition is ordered. Registry is directed to restore the petition in CMP(MD)No.13932 of 2024, on file and list the same on 23.03.2026.
