ORDER

This Writ Petition is filed to issue a Writ of Certiorarified Mandamus, calling for the records relating to the impugned proceedings issued by the second respondent in Na.Ka. No.3954/A6/2023 dated 20.11.2023 and quash the same and further direct the second respondent to release forthwith annual increment admissible to the petitioner in the post of B.T. Assistant (English) w.e.f. 01.06.2018, with all attendant benefits including the arrears of salary thereon.

2. The issue raised in this writ petition is no longer res integra, as it has been decided by the Hon'ble Division Bench of this Court in W.A(MD)No.558 of 2021 dated 22.06.2023. The Hon'ble Division Bench in a similar circumstances where the appointment of the teacher 2/5

had been approved, had directed granting of annual increment by holding that such teachers are entitled for such annual increment and also issued directions to pay the same to the teacher and continue to pay the increments. Such direction was also directed to be complied within a period of eight weeks from the date of receipt of a copy of the order.

3. Applying the said law laid down by the Hon'ble Division Bench in the aforesaid judgment, this writ petition stands allowed and the respondents are directed to calculate the annual increment which the petitioner would be entitled to and disburse the same within a period of twelve weeks and thereafter continue to pay the regular annual increment as applicable to the petitioner. No costs. Consequently, connected miscellaneous petition stands closed.
