ORDER

This Petition is filed to relax the condition imposed by this Court Crl.MP(MD)No.14442/2023 in Crl.A(MD)No.782/2022, dated 13.10.2023.

2.The first respondent registered a case in Crime No.382 of 2022 for the offence under Sections 3(1)(r), 3(1)(s), 3(1)(w)(ii) of SC/ST Prevention of Attrocities Act, and 3(2)(V) of SC/ST Prevention of Attrocities Act.The Petitioner filed a bail application before the trial 2/6

Court and the same was dismissed on 18.10.2022 and therefore, the Petitioner filed the present Criminal Appeal in Crl.A(MD)No.782 of 2022.The Petitioner also filed an application before this Court to release him on bail and this Court was pleased to enlarge the Petitioner on bail on conditions stated therein vide order, dated 29.11.2022.The Petitioner thereafter filed an application for relaxation in Crl.M.P(MD)No.105 of 2023 and this Court vide order, dated 5.1.2023, relaxed the conditions. The Petitioner thereafter again filed Crl.M.P(MD)No.14442 of 2023, wherein, this Court vide order, dated 13.10.2023, further relaxed the condition imposed in the order, dated 5.1.2023, by permitting the Petitioner to report before the concerned trial Court once in three months ie., on the first working day of January, April, July and October at 10.30 a.m until further orders. .The petitioner has now filed this application to relax the condition imposed in Crl.MP(MD)No.14442/2023 in Crl.A(MD)No.782/2022, dated 13.10.2023.

3.The learned counsel for the Petitioner submitted that the Petitioner is appearing before the trial Court on the first working day from 13.10.2023, as per the orders or this Court. The learned counsel for the Petitioner further submitted that the Petitioner is constrained to apply 3/6

for continous leave in the Bank, to comply with the order of this Court, which is affecting his employment and therefore, prayed for relaxation of condition, as aforementioned.

4.The learned Government Advocate(Crl.Side), appearing for the respondent/Police submits that in the trial, 17 witnesses was sought to be examined and out of whom, 16 witnesses have already been examined and one more witness remains to be examined on the side of the prosecution. The learned Government Advocate, would further submit that the trial is at the verge of completion.Therefore at this stage, further relaxation should not be permitted.

5.It is seen that this Court relaxed the conditions twice. The condition that was imposed in the order, dated 13.10.2023 is to appear before the concerned trial Court once in three months on the first working day of January, April, July and October at 10.30 a.m until further orders. Since the trial is at the verge of completion, this Court does not find any compelling reasons to further relax the conditions imposed by this Court vide order, dated 13.10.2023. 4/6

6.The Criminal Miscellaneous Petition is accordingly dismissed. 09-12-2025 To 1.The Special Judge for Exclusive Trial of Cases under SC/ST(PoA) Act, Dindigul.
