ORDER

This Criminal Original Petition has been filed to direct the learned III Additional District and Sessions Judge(PCR Cases), Madurai, to consider the bail application on the surrender of the petitioners/Accused No.5 and 6 on the same day in connection with Crime No.560 of 2025 on the file of the 2nd respondent police.

2. Considering the nature of the relief sought for, notice to the 3rd respondent is dispensed with.

3. The case of the prosecution is that on 18.11.2025, at about 14:00 hrs, the petitioners (Accused Nos.5 & 6) and other accused attacked the de facto complainant, a JCB operator, with knives, using casteist slurs, over a dispute regarding Panjami Lands usage. The incident was reported to the police 8 hours later, at 22:00 hrs, resulting in the registration of an FIR against 9 named and 3 unnamed accused. Based on these allegations, the police registered a 2/5

case in crime No.560/2025 under Sections 191(2), 191(3), 49, 296(b), 118(1), 351(3) of BNS and Section 3(1)(r), 3(1)(s), 3(2) (va) of the SC/ST Act offences.

4. Heard the learned counsels on either side and carefully perused the materials available on record.

Considering the limited scope of the relief sought for, this Court hereby direct the learned III Additional District and Sessions Judge(PCR Cases), Madurai, to issue prior notice to the de facto complainant and thereafter to consider the bail application of the petitioners on the same day of their surrender before that Court in connection with Crime No.560 of 2025 on the file of the 2nd respondent police.
