O R D E R

The writ petition is filed challenging the impugned order of the 3rd respondent in proceedings Na.Ka.No.2862/2025/A1 dated 14.05.2025, whereby the patta for the land in survey No.785/19 situated at Ponnamaravathy East Village, Pudukkottai District was unlawfully transferred to the 4th respondent, and for a consequential direction to the respondents 1 and 2 to restore the patta in favour of the petitioner.

2. Both parties are present and by considering their arguments, this Writ Petition is disposed of at the admission stage itself. 2/5

3. On an application made by the third respondent for transfer of patta, the impugned order came to be passed transferring the patta in favour of the 4th respondent.

4. The principles of natural justice requires a notice to be served upon the petitioner in the event of transfer of patta, which is standing in his name.

5. The learned Government Advocate for the respondents 1 to 3 fairly concedes that no notice was issued before transferring the patta standing in the name of the petitioner.

6. In the said circumstances, the impugned order is set aside and the matter is remanded back to the Tahsildar/3rd respondent, for the purpose of hearing the petitioner, after giving notice to the concerned parties.
