ORDER
Seeking to quash the First Information Report in Crime No.156 of 2025 on the file of the first respondent police, this Criminal Original Petition has been filed.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

The learned counsel for the petitioner submitted that the First Information Report came to be registered in respect of the alleged offences of receiving bribe amounts from six different persons on 03.12.2019, 11.12.2019, 11.02.2020, 01.04.2020, and 03.11.2020. However, it was contended that even prior to the said dates, the petitioner had been transferred from the concerned destination as early as on 17.06.2019. Hence, the petitioner is in no way connected with the allegations made by the de facto complainant and therefore, sought the indulgence of this Court to quash the First Information Report.

Per contra, Mr.M.Sakthi Kumar, learned Government Advocate (Criminal Side), on instructions, submitted that the complaint of the de-facto complainant clearly disclose that they had separately met the petitioner and paid bribe amounts for obtaining free site pattas to their respective lands, on the promise that the petitioner would make arrangements for the same by using his influence over the erstwhile office. When the de-facto complainant clearly mentioned the name of the petitioner, the submission of the learned counsel for the petitioner that he was transferred in June 2019 will not rescue the petitioner 2/4
from the offences alleged against him. It was further submitted that only a First Information Report has been registered, which cannot be treated as an encyclopedia, the investigation is still pending, and therefore sought dismissal of the present petition.
5. Considering the fact that the de-facto complainant specifically alleged that the bribe amounts were paid to the petitioner on 03.12.2019, 11.12.2019, 11.02.2020, 01.04.2020, and 03.11.2020, this Court is not inclined to interfere with the pending First Information Report.
6. Accordingly, this Criminal Original Petition is dismissed. Consequently, the connected Criminal Miscellaneous Petition is closed. 16.12.2025 NCC : Yes / No Index : Yes / No Internet : Yes / No mkn 3/4
