ORDER

The present writ petition has been filed seeking a mandamus to direct the 2nd respondent school to issue transfer certificate to the petitioner's son, who has completed SSLC in the academic year 2022-23.

2. According to the learned counsel for the 2nd respondent, the admitted fees of the petitioner towards the tuition fees is Rs.1,30,000/-, after waiving a sum of Rs.60,000/-. Therefore, unless the entire amount is paid, the transfer certificate could not be issued.

3. However, the learned counsel for the petitioner submitted that due to poverty, the petitioner is not in a position to pay the said amount and he has drawn a demand draft for a sum of Rs.50,000/-, which is handed over to the learned counsel for the 2nd respondent today. The petitioner has also filed an affidavit to the effect that he would pay another sum of Rs.20,000/- on or before 31.12.2025. His affidavit is taken on record.

4. The 2nd respondent school is directed to issue the transfer certificate on or before 22.12.2025. It is made clear that this cannot be cited as a precedent for any other case.
