ORDER
Heard the learned counsel for the writ petitioner and the learned Additional Government Pleaders for the respondents 1 to 3. Issuance of notice tot he respondents 4 to 10 is dispensed with. 2/6
2.This writ petition cannot be entertained. This is because the petitioner had already filed W.P.(MD)No.21694 of 2022 for the very same relief. The said writ petition was disposed of on 14.09.2022 in the following terms:- "8.In view of the above submission and also considering the limited scope of the relief sought for, this Court, without going into the merits of the claim made by the petitioner, directs the respondents 1 to 3, to consider the representation of the petitioner, dated 16.02.2021 in the light of the orders passed by the Block Development Officer, Athoor Panchayat Union, Dindigul District, dated 12.03.2021 and pass appropriate orders, on merits and in accordance with law, after giving due notice to all the parties concerned, within a period of eight (8) weeks from the date of receipt of a copy of this order."
3.When the matter was taken up for admission, the learned Additional Government Pleader submitted that pursuant to the direction given in the earlier writ petition, survey was conducted and encroachments were also removed. On direction from us, copy of the instructions given to the learned Additional Government Pleader has also been served on the learned counsel for the petitioner. If the petitioner is 3/6
still aggrieved, the only remedy open to the petitioner to file a contempt petition.
4.With the aforesaid observation and liberty, this writ petition is dismissed. No costs.
