Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the Respondents No.1 and 2 to remove the illegal encroachments made by the Respondent No.3 to 6 in "Odai" situated in S.No.400 and Nilaviyal Odai situated at Kottankulam Village, Rajapalayam Taluk, Virudhunagar District within the time frame stipulated by this Court. ORDER
Heard the learned counsel for the writ petitioner and the learned Special Government Pleader for the respondents 1 and 2. Issuance of the notice the respondents 3 to 6 is dispensed with. 2.The writ petitioner is a resident of Thiruvalluvar Nagar in Rajapalayam. Her grievance is that encroachments have been committed on water bodies in Kothankulam Village where the writ petitioner has lands.

3.The allegation of the writ petitioner is in two parts. She alleges that in S.No.400, there are encroachments. She also states that a geological stream running through S.Nos.382, 395, 396 and 393 has also been encroached.
4.The learned Special Government Pleader on written instructions, states that S.No.400 has been classified as a water body (Tank). He also confirms that a geological stream runs through the petition mentioned survey numbers.
5.We direct the second respondent to conduct survey of the petition mentioned water body as well as the geological stream. Notices will be issued to all the interested persons. If the survey exercise reveals that there is encroachment, individual notices will be issued to all the encroachers and by adhering to due process of law, the encroachments shall be removed. The entire exercise shall be completed within a period of four months from the date of receipt of a copy of this order. 3/6
