impugned order passed by the first respondent vide proceedings in NO.RO/TRY/431/2025-CA dated 09.11.2025 and quash the same as illegal and consequently direct the first respondent to grant 21 days ordinary leave without police escort to the petitioner's husband namely Balamurugan, S/o.Pakkirisamy,Life Convict PIDNo.179762 confined at Central Prison, Trichy.

O R D E R
[Order of the Court was made by G.K.ILANTHIRAIYAN, J.] The prayer in the petition is to quash the impugned order passed by the first respondent in NO.RO/TRY/431/2025-CA dated 09.11.2025 and direct the first respondent to grant 21 days ordinary leave without police escort to the petitioner's husband namely Balamurugan, S/o.Pakkirisamy,Life Convict PIDNo.179762 confined at Central Prison, Trichy.
2. It is the case of the petitioner that her husband was convicted by the III Additional District and Sessions Court,Pattukottai in S.C. No.260 of 2013 on 28.06.2019 and sentenced to undergo life imprisonment for the offence
under Section 302 of IPC. Aggrieved over the same, the convict has filed an appeal before this Court in Crl.A(MD) No.330 of 2019 and the same was dismissed by this Court on 24.08.2022. Against which the convict has filed an appeal before the Hon'ble Supreme Court and the same is pending in Diary No. 43455/2023 in SLP(Crl.)No.16218 of 2023. The petitioner submitted an application seeking ordinary leave for a period of 21 days. After considering the request made by the petitioner, the first respondent granted ordinary leave to the convict with escort. The petitioner being a poor person, could not afford the cost of escort.
3. In view of the above, the condition imposed in the order dated 09.11.2025 directing the convict to go on ordinary leave with escort is modified and he shall go on ordinary leave without escort. However, the convict is directed to comply with the usual conditions imposed by the jail authorities and he should also report before the fourth respondent police daily at 05.30 p.m. He shall duly comply with the conditions and return to the prison on expiry of the leave period.
4. Accordingly, the order of the first respondent dated 09.11.2025 is quashed in sofar as the ordering escort alone and the Writ Petition is disposed of.
