ORDER

This Criminal Original Petition has been filed to direct the learned III Additional District Court (PCR), Madurai, Madurai, to accept the surrender of the petitioner in connection with Crime No. 560 of 2025 on the file of the Inspector of Police, Melur Police Station, Madurai District.

2. Considering the nature of the relief sought for, notice to the 3rd respondent is dispensed with.

3. The case of the prosecution is that the de facto complainant, a Hindu Paraiyar and JCB operator, had a dispute with Rajendran (Hindu Kailar Community) over sand mining from Panchami lands. The complainant had previously won a case regarding these lands and has taken steps for issuing pattas to community members. On 18.11.2025, the complainant was attacked by Accused Nos.1 to 4 and others with a sword, resulting in severe injuries, including the loss of his right hand. The accused also used abusive language and threatened him. The incident stemmed from ongoing disputes over the Panchami lands, with the accused allegedly targeting the 2/5

complainant due to his community work. Based on these allegations, an FIR was registered against the petitioner under Section 191(2), 191(3), 49, 296(b), 118(1), 109(1), 351(3) of BNS and 147, 148, 109, 294(b), 324, 307, 506(ii) of IPC and Section 3(i)(r), 3(1) (s) and 3(2) (va) of SC/ST (POA) Act.

4. Heard the learned counsels on either side and carefully perused the materials available on record.

5. Considering the limited scope of the relief sought for, this Court hereby direct the learned III Additional District Court (PCR), Madurai, Madurai, to issue prior notice to the de facto complainant and thereafter to consider the bail application of the petitioner on the same day of his surrender before that Court in connection with Crime No.560 of 2025 on the file of the 2nd respondent police.
