PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the first respondent to direct the second respondent to cancel the Patta No.6902 for the property in Survey No.96/1B an extent of 72 Cents in Usilampatti Village, Usilampatti Taluk, Madurai District and grant joint patta in the petitioner's name by considering her representation dated 12.07.2025, within the period as stipulated by this Court. ORDER

This Writ Petition has been filed seeking the issuance of a Writ of Mandamus, directing the first respondent to instruct the second respondent to cancel Patta No.6902 in respect of the property in Survey No.96/1B, measuring 72 cents, situated in Usilampatti Village, Usilampatti Taluk, Madurai District, and to grant joint patta in the petitioner's name by considering her representation dated 12.07.2025, within a time frame to be stipulated by this Court.

2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.

3. Since no adverse orders are going to be passed against the respondents 4 to 7, notice to the respondents 4 to 7 is hereby dispensed with.

According to the petitioner, originally, her father was the rightful owner of the property in Survey No.96/1B, measuring 72 cents, situated in Usilampatti Village, Usilampatti Taluk, Madurai District. The property is currently recorded under Patta No.6902, which is not in the petitioner's name alone, causing legal and practical difficulties for the petitioner in exercising her rights over the property. Hence, on 12.07.2025, the petitioner submitted a representation requesting the cancellation of Patta No.6902 and the issuance of a joint patta in her name, in accordance with law and relevant records. Despite the petitioner's representation, the official respondents have not taken necessary action, resulting in hardship and denial of the petitioner's lawful rights. The petitioner is entitled to have the Patta corrected and joint patta issued in her name, and the official respondents are under a statutory and legal obligation to act upon her representation. Hence, the present Writ Petition.

5. The learned Additional Government Pleader for the respondents 1 to 3 submits that the petitioner's representation will be considered on its merits and in accordance with law.

Recording the above submission, and without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the second respondent to consider the petitioner's representation dated 12.07.2025, on merits and pass appropriate orders in accordance with law within a period of four months from the date of receipt of a copy of this order. The representation shall be considered and disposed of after conducting an enquiry. The second respondent is directed to provide reasonable opportunity during such enquiry to the petitioner, the respondents 4 to 7 herein and also to the other persons, who may be affected by such decision. In the event of any rival claims, the parties are at liberty to work out their remedies before the Civil Court. There shall be no order as to costs. NCC : Yes / No (K.SURENDER, J.)
