PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 1st respondent to consider and issue the passport to the petitioner in pursuance of the passport application bearing File No.MD1065752314725 dated 06.10.2025.

ORDER

The present writ petition has been filed seeking a mandamus as against the first respondent herein to consider the Tatkal passport application of the petitioner dated 06.10.2025.

2. The learned Government Advocate(crl.side) appearing for the second respondent submits that the petitioner has been implicated in a criminal case in Cr.No.476 of 2021 on the file of the second respondent and investigation is pending. So far, charge sheet has not been laid.

3. This Court in a judgment reported in 2014 (8) MLJ 61 has held that mere pendency of FIR would not be a bar for considering an application seeking passport.

4. In view of the above said facts, the first respondent herein is directed to consider the request of the petitioner for Tatkal passport based upon his request dated 06.10.2025 and pass orders within a period of four weeks from the date of receipt of a copy of this order.

5. With the above said observations, this writ petition stands disposed of. No costs.
