ORDER

The petitioner / A4, who was arrested and remanded to judicial 1/5

custody on 27.09.2025 for the offences punishable under Sections 8(c) r/w 20(b)(ii)(C), 25 and 29(1) of NDPS Act, in Crime No.19 of 2023 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on 16.01.2023, at about 06.30 a.m, on the secret information, the respondent police went to the place of occurrence at Andipatti to Madurai main road near water tank and intercepted the vehicle bearing Reg.No.TN-65-AW-5956. On searching, the accused were found in illegal possession of 1200 kg of ganja. Hence the case.

The learned counsel appearing for the petitioner would submit that the petitioner is innocent and he was falsely implicated in this case and he has not committed any offence as alleged by the prosecution. He would further submit that based on the confession made by the coaccused, this petitioner has been implicated in this case and the petitioner has been arrested and remanded to judicial custody on 27.09.2025. Therefore, prayed to grant bail for the petitioner. 2/5

4. The learned Additional Public Prosecutor appearing for the respondent strongly opposed to grant bail to the petitioner on the ground that the quantity involved in this case is a commercial quantity and the petitioner is having 2 previous cases and among them, one case is similar in nature.

5. This Court heard both sides and perused the materials available on record.

Considering the rival submissions made by the learned counsel on either side, nature of offence, and the quantity involved in this case is a commercial quantity and the petitioner was included one of the accused based upon the confession of the co-accused and the petitioner is having 2 previous cases and one is similar in nature and thereby, the petitioner has failed to satisfy the conditions contemplated under Section 37 of the NDPS Act, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, this Criminal Original Petition stands dismissed. 3/5
