ORDER

This criminal original petition has been filed seeking to direct the first respondent to monitor the investigation in Crime No.46 of 2024 dated 16.02.2024 pending on the file of the second respondent and to take necessary action as against the culprits.

2.The learned counsel for the petitioner submits that the petitioner had lodged a complaint against one Palaniyappan and Ranjith Kumar for the offences under Sections 417, 420 of IPC in Crime No.46 of 2024. According to the petitioner, the said Palaniyappan and Ranjithkumar received a sum of Rs.7,70,000/- from the petitioner for securing a job to his son. He further submitted that though the petitioner lodged the complaint against several persons, the respondent police registered a case against only two persons. Despite the petitioner giving a representation to the first respondent to conduct a fair investigation and file a final in this case, the second respondent has not taken any further action. Hence, the present petition has been filed. 3.This Court considered the rival submissions made and also perused the materials placed on record.

4.The grounds raised by the petitioner can very well be considered by the investigating officer during the course of investigation. The FIR is nothing but registering the complaint in the register of the Police. The purpose of investigation is to find out truth whether the complaint is genuine or not. The investigating officer is expected to conduct the investigation in a fair and proper manner by considering the evidence produced by the defacto complainant and the accused.

5.Therefore, the second respondent is directed to report the stage of the investigation to the first respondent at every week. The first respondent/The Superintendent of Police, Virudhunagar District is directed to monitor the investigation in Crime No.46 of 2024 on the file of the second respondent. 6.With the above direction, this Criminal Original Petition is disposed of. 05.12.2025 NCC : Yes / No Index : Yes / No vsg 3/5
