ORDER

This Criminal Original Petition has been filed to direct the learned 1st Additional District and Sessions Court (PCR Act Cases), Thanjavur District, to accept the surrender of the petitioner and consider his bail application on the same day on merit relating to Crime No.541 of 2025 dated 15.11.2025.

2. Considering the nature of the relief sought for, notice to the 3rd respondent is dispensed with.

3. The case of the prosecution is that the de facto complainant is a driver of a private bus and he belongs to Scheduled Caste community. There is previous enmity between the petitioner and the de facto complainant and one FIR is also pending against the petitioner based on the complaint of the de facto complainant. Due to this, the petitioner follows the de facto complainant and threatens him often. In these circumstances, on 09.11.2025, when the de facto complainant was standing opposite the bus stop, the petitioner 2/5

abused him with filthy language and also insulted him by using his caste name. Further, he threatened him to withdraw the earlier FIR by using a deadly weapon. Hence, the case in Crime No.541 of 2025 was registered.

4. Heard the learned counsels on either side and carefully perused the materials available on record.

Considering the limited scope of the relief sought for, this Court hereby directs the learned 1st Additional District and Sessions Court (PCR Act Cases), Thanjavur District, to issue prior notice to the de facto complainant and thereafter to consider the bail application of the petitioner on the same day of his surrender before that Court in connection with Crime No.541 of 2025 on the file of the 2nd respondent police.
