For Petitioner : Mr.C.Gangai Amaran For Respondents : Mr.S.Sivanesan COMMON JUDGMENT (Judgment of the Court was delivered by DR.G.JAYACHANDRAN, J.) The appellants /writ petitioners herein are the TASMAC salesmen and were suspended on 28.08.2025 on the allegation that they are collecting Rs.10 for bottle, over and above the price fixed. The suspension orders were challenged by the writ petitioners in W.P. (MD)No.25018 of 2025 and W.P.(MD)No.25019 of 2025. The said writ petitions were dismissed by the learned Single Judge vide common order dated 03.11.2025. Being aggrieved by the said order, writ petitioners have filed the present writ appeals on the ground that the writ petitioners were suspended on presumption and on the basis of collective responsibility.
2.The learned counsel for the appellants/writ petitioners submits that the appellants are ready to cooperate with the enquiry, but the suspension order has put them under great prejudice. It is contended that the explanation given by them on 28.08.2025 was not properly considered before passing the suspension order. 2/5
3.The learned counsel for the appellants further submits that after filing of the instant writ appeals, the suspension order had been revoked and the appellants have joined duty. However, they are aggrieved by certain observations made by the learned Single Judge while disposing the writ petitions, as the said observations will cause prejudice to them in the departmental enquiry. 4.Taking note of the said submission, we dispose of these writ appeals with a direction that the enquiry be commenced and completed within a period of six months from the date of receipt of a copy of this order. It is also made clear that any observations, made by the writ Court in the writ petition, shall not prejudice the enquiry officer in any manner while deciding the proposed charge sheet against the appellants.
