O R D E R
This writ petition has been filed seeking a direction to the 1st respondent to direct the 2nd respondent not to conduct survey of the property in Survey No.287/3A1 belongs to 3rd respondent of Akkalur revenue Village, Thiruvadanai Taluk, Ramanathapuram District by considering the petitioner's objection dated 15.11.2025.
2. Heard the learned counsel for the petitioner and the learned Government Advocate appearing for the respondents 1 and 2. By consent of both sides, the writ petition itself is taken up for final disposal at the stage of admission itself. Since no adverse orders are going to be passed against the third respondent, notice is dispensed with.
3. The petitioner submitted a representation to the 1st respondent on 15.11.2025 making objection for conducting survey in Survey No. 287/3A1 belongs to 3rd respondent of Akkalur revenue Village, Thiruvadanai Taluk, Ramanathapuram District. However, no action has 2/5
been taken on the said petition. Hence, the present writ petition has been filed.
4. Learned Government Advocate, appearing for the respondents 1 and 2, submits that one of the interested party moved this Court by filing WP(MD) No.19664 of 2025, wherein, an order has been passed on 21.07.2025 to conduct survey. Pursuant to the said order, when the officials went to survey the land, it is informed that the petitioner herein objected for the same on the ground that he is cultivating the land.
5. Since the officials gone to the land in question pursuant to the orders passed by this Court, the question of restraining the officials from conducting survey does not arise. The writ petition fails and the same is dismissed. Needless to say, the petitioner shall be put on notice while conducting survey and opportunity should be given to him. There shall be no order as to costs.
