PRAYER : Petition filed under Section 528 of BNSS, 2023, to direct the respondents 1 and 2 particularly the second respondent to take appropriate legal action on the petitioner's complaint dated 27.11.2025 in accordance with law of BNSS, 2023.

ORDER

This criminal original petition has been filed seeking a direction to the respondents 1 and 2 particularly the second respondent to take appropriate legal action on the petitioner's complaint dated 27.11.2025 in accordance with law of BNSS, 2023.

2. Considering the nature of the relief sought for, notice to the respondents 3 to 5 is dispensed with.

3.The learned counsel appearing for the petitioner submitted that the respondents 3 to 6, who are none other than the parents of the petitioner and they are threatening the petitioner to return the property, which was earlier 2/5

settled in favour of the petitioner by the parents. In this regard, the petitioner had lodged a complaint 27.11.2025. However, the respondents 1 and 2 police has not taken any steps against the respondents 3 to 5. Hence, the present petition is filed.

4.The learned Government Advocate (Crl. Side) submitted that the third and fourth respondents, being the parents of the petitioner, out of their own volition and affection, had settled certain properties, including land, in favour of the petitioner, in which he is residing. However, when the petitioner decided to enter the said land for the purpose of clearing trees and other plantations, his parents allegedly waylaid him from entering the property, which led to the filing of the present petition.

5.Heard the learned counsel on either side and perused the materials available on record.

6.The dispute is purely civil in nature. This Court is of the considered view that the dispute is nothing but a family dispute, for which the petitioner ought not to have approached the police. The petitioner is directed to resolve the dispute with his parents amicably.
