PRAYER : Petition filed under Section 528 of BNSS, 2023 to direct the respondents 1 and 2 to transfer the investigation in Crime No.434 of 2024 from the file of the third respondent Police to CBCID Police or any other investigation agency by considering the petitioner's representation dated 03.11.2025.

ORDER

Seeking to direct the respondents 1 and 2 to transfer the investigation in Crime No.434 of 2024 from the file of the third respondent Police to CBCID Police or any other investigation agency by considering the petitioner's representation dated 03.11.2025, this petition is filed. 2.The learned counsel appearing for the petitioner submitted that the matter is all about the offence under Sections 406 and 420 of IPC as against the accused persons, in respect of which, an FIR in Crime No. 434 of 2024 was 2/6

registered. Despite the lapse of more than two years, the investigation has remained stagnant, and the respondent police had failed to conduct a proper investigation. Consequently, the petitioner was constrained to file Crl.O.P. (MD) No. 4029 of 2024 before this Court, seeking a direction to the third respondent to expedite the investigation. This Court, vide order dated 04.03.2025, directed the third respondent to file a final report within a period of two months. However, despite the said direction, there is no progress in the investigation. Hence, the present petition is filed seeking transfer of the investigation.

3.Per contra, the learned Government Advocate (Crl. Side), on instructions, submitted that pursuant to the order passed by this Court in Crl.O.P. (MD) No. 4029 of 2024, the de facto complainant was required by the second respondent police to produce all necessary documents to facilitate the investigation. The petitioner has not produced the said documents till date, albeit the second respondent police had taken action, and as of this morning, one of the accused has been arrested. He further submitted that the investigation would be concluded expeditiously by duly arresting all the other accused shortly.

4.Accordingly, this Court hereby directs the second respondent police to closely monitor the investigation conducted by the third respondent. The third respondent is directed to report the progress of the investigation to the second respondent on every weekend and to conclude the investigation within a period of four weeks from today.

5. With the above directions, this Criminal Original Petition is disposed of.
