ORDER
The present petition has been filed by the first accused in Spl.S.C.No. 67 of 2023 on the file of the III Additional District Court (PCR), Madurai seeking to quash the said charge sheet wherein the petitioner has been charged with the offences under Sections 294(b), 448, 355, 323, 324, 336, 506(ii) I.P.C and Section 4 of Prohibition of Harassment of Women Act, 2002, r/w Section 3(1)(r), 3(1)(s), 3(2)(va) of the Scheduled Caste and the Scheduled Tribes (Prevention of Atrocities) Amendment Act, 2015. 2.According to the learned counsel appearing for the petitioner, the allegations in the charge sheet are frivolous in nature and arising from a dispute regarding cow grazing and therefore, no charges have been made out as against the petitioner. The ingredients of Section 294(b) of I.P.C have not been made out, in view of the fact that the entire incident said to have taken place in the house of the defacto complainant. For the past three years, the trial is not begun and therefore, it is a harassment of the petitioner herein. 2/5
3.Heard both sides and perused the material records. 4.A perusal of the charge sheet reveals that the prima facie has been made out as against the petitioner and therefore, this Court is not inclined to interfere at this stage especially when no legal grounds have been raised for quashing the charge sheet.
5.The trial Court is directed to dispose of the case on merits without being influenced by any one of the observations made by this Court. Considering the fact that the trial has not begun for the past three years, the personal appearance of the petitioner herein is dispensed with unless specifically directed by the trial Court.
6.With the above said observations, this Criminal Original Petition stands dismissed. Consequently, connected miscellaneous petitions are closed.
