O R D E R

The petitioner is working as a Lecturer in the second respondent Government Polytechnic College and is also serving as Head of Department (In-Charge) (Polymer Technology Department) in the second respondent college.

2. The petitioner has already approached this Court by way of filing W.P(MD).No.9332 of 2023, wherein this Court vide order dated 27.06.2024 directed the officials to consider the petitioner's name for inclusion in the promotional panel for the year 2022-2023 to the post of Head of Department/ Polymer Technology, by taking into account his qualification. As against the said order, the respondents filed W.A(MD).No.1427 of 2025 before this Court and the same is pending.

At this juncture, apprehending that the respondents are attempting to fill up the post of 'Head of Department', the petitioner has filed this writ petition seeking a writ of mandamus forbearing the respondents from filling up the post of Head of Department in the second respondent College in any manner.

4. When this writ petition is taken up for hearing, it is reported before this Court that one Hemameenakshi got transferred from Chennai to the second respondent college to the post of Head of Department (Polymer Technology). 5.In view of the above, the post sought for by the petitioner has already been filled. The petitioner has neither challenged the transfer order nor the promotion panel. Though the petitioner obtained a favourable order in W.P.(MD) No.9332 of 2023, the same is the subject matter of challenge in W.A. (MD) No.1427 of 2025, which is presently pending. Hence, this Writ Petition is closed with liberty to the petitioner to work out his remedy depending upon the outcome of W.A.(MD) No.1427 of 2025. No costs. Consequently, the connected Miscellaneous Petition is also closed.
