ORDER : The Court made the following order :- The petitioner/Accused, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 8(c), 20(b)(ii)(B), 25, 29(1) of NDPS Act, in C.C.No.583 of 2023 on the file of the Principal Special Court for NDPS Act Cases, Madurai, in Crime No.348 of 2022, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with other accused was found in illegal possession of 2.2 kilograms of ganja. Hence, the complaint.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor appearing for the respondent Police submitted that a non-bailable warrant was issued 2/5

against the petitioner. Therefore, he opposed for grant of anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case, this Court is directing the petitioner to surrender before the concerned Court and file a recall application. On such application, the learned Special Judge shall consider the same in accordance with law on merits on the same day.

6. With the above said directions, this Criminal Original Petition is closed.
