ORDER
Seeking to quash the proceedings in Spl.S.C.No.165 of 2025 on the file of the Special Court for Exclusive Trial of Cases under POCSO Act, Madurai District, for the offences under Sections 11(1), 11(4), and 12 of the Protection of Child from Sexual Offences Act, 2012 r/w. Section 351(2) of the Bharatiya Nyaya Sanhita (BNS), 2023, this Criminal Original Petition has been filed.

It is the case of the prosecution that on 11.11.2024, between 4.30 p.m. and 5.00 p.m., when the de-facto complainant's wife and his minor daughter/victim girl went to attend a parent-teachers meeting, the petitioner sat near the victim girl and sexually abused her. Thereafter, on 25.01.2025, the petitioner allegedly went to the victim girl's school for the annual day celebration and is said to have spoken to the victim girl, stating that she was looking gorgeous and commenting on her dress. It is further alleged that while the de-facto complainant and the victim girl were proceeding towards the police station, the petitioner's relatives and the petitioner's sister, namely Poovitha, who has been arrayed as A2 in this case, criminally intimidated them to withdraw the case.

3. The petitioner, appearing as party-in-person, submitted that he has been falsely implicated in this case, which has culminated in the filing of a final report before the Special Court for Exclusive Trial of Cases under the POCSO Act, Madurai.
4. Mr.S.Ravi, learned Additional Public Prosecutor appearing for the 1st and 2nd respondents, raised objections and prayed for dismissal of this petition, having regard to the gravity of the offences alleged under the provisions of the POCSO Act.
5. Heard the learned counsel appearing on either side and perused the materials placed before this Court.

In this case, a final report has been laid by the respondent police for the offences under Sections 11(1), 11(4), and 12 of the Protection of Children from Sexual Offences Act, 2012, read with Section 351(2) of the Bharatiya Nyaya Sanhita (BNS), 2023. On a careful reading of the charge sheet, it is evident that there are clear allegations of indulging in sexual activities against the victim girl. In view of the seriousness of the allegations, this Court is not 3/5
inclined to interfere, and accordingly, this petition is liable to be dismissed.
