ORDER

Heard Mr.B.Jameelarasu, learned Counsel for petitioners and Mr.A.Thiruvadikumar, learned Additional Public Prosecutor, who accepts notice on behalf of Respondent.

2. Criminal Miscellaneous Petition has been filed, praying to suspend the sentence imposed on petitioners by Judicial Magistrate, Keeranur, Pudukkottai District, in C.C. No. 13 of 2017 dated 11.07.2023, which was confirmed by District and Sessions Judge, Pudukottai in C.A. No. 88 of 2023 dated 29.10.2025.

Learned counsel for petitioners would submit that petitioners were convicted by Judicial Magistrate, Keeranur, Pudukkottai District, for offences punishable under Sections 324 of IPC in C.C.No.13 of 2017, dated 11.07.2023 and sentenced as follows: (i) to undergo two years rigorous imprisonment and to pay a fine of Rs.5000/- each in default, to undergo four weeks simple imprisonment. Aggrieved, petitioners filed C.A. No. 88 of 2023, before District and Sessions Judge, Pudukottai and the lower Appellate Court vide order dated 29.10.2025, 2/6

partly allowed the appeal and modified the conviction and sentence passed by Trial Court, as follows: (i) the sentence of fine of Rs.5,000/- each, in default of such payment, to undergo simple imprisonment for 4 weeks each for that offence, passed by the trial Court are confirmed; (ii) the sentence of imprisonment imposing rigorous imprisonment for 2 years each for that offence is set aside. Aggrieved, petitioners filed present Criminal Revision Petition in Crl.RC(MD)No.1537 of 2025 before this Court along with instant miscellaneous petition seeking suspension of sentence and bail.

4. Learned Counsel for petitioners would further submit that petitioners have raised substantial grounds in the above revision, which requires consideration. Hence, he prayed for granting suspension of sentence and bail to petitioners.

Learned Additional Public Prosecutor appearing for respondent opposed the submissions of learned counsel for petitioners and submitted that judgments passed by Courts below are as per law after considering the entire evidence, thus the relief sought by petitioners at this stage be refused by this Court.

6.Considering the fact that there are arguable points raised in revision and taking into consideration, facts and circumstances of the case and that it is also likely to take a while before the revision is finally heard1, this Court is inclined to grant suspension of sentence and bail, on the following conditions, till the disposal of above Criminal Revision: i) The petitioners are directed to be enlarged on bail on their executing a bond each for a sum of Rs.

10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Keeranur, Pudukkottai District; ii) The petitioners and sureties shall affix their photographs and Left Thumb Impression in the bond and the above said Court may obtain a copy of their Aadhaar card or Bank pass Book to ensure their identity; iii) The petitioners shall appear and sign before the learned Judicial Magistrate, Keeranur, Pudukkottai District, on the first working day of every month at 10.30 a.m.

under Section 317 Cr.P.C. (corresponding to 355 B.N.S.S) and shall appear before the trial Court on any other day in lieu of the date of their absence, as directed by the trial Court.
