ORDER : The Court made the following order :- The petitioner, who was arrested and remanded to judicial custody on 25.10.2025 for the offences punishable under Sections 77, 308(3) and 351(2) of BNS Act and Section 66E of Information Technology Act, in Crime No.354 of 2025 on the file of the respondent police, seeks bail.

The case of the prosecution is that the petitioner was working as a CCTV operator at Lalitha Jewellers and allegedly recorded intimate videos of women employees, and that A-2 threatened the women employees with uploading the said videos on social media unless money was paid to him. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offences as alleged by the prosecution. He further submitted that the petitioner is in judicial custody from 25.10.2025. Hence, he seeks bail to the petitioner.

4. The learned Additional Public Prosecutor submitted that the petitioner has no previous case and that the investigation is still in progress. However, he opposed for grant of bail to the petitioner.

5. This Court has already granted interim bail. Taking into consideration the facts and circumstances of the case and since the petitioner has complied with the condition imposed in the interim bail regularly, the interim bail already granted is made absolute and this Court is inclined to grant bail to the petitioner. Accordingly, the petitioner is ordered to be released on bail with certain conditions. [a] the petitioner shall report before the respondent police daily at 10.30 a.m., until further orders. [b] the petitioner shall not tamper with the evidence or witness either during investigation or trial. [c] the petitioner shall not abscond either during investigation or trial.

[d] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take 3/5

appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner is released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].

[e] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 BNS.
