Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the respondents 1 to 3 to conduct enquiry by taking into account the petitioner compliant dated 18.08.2025 and initiate action against the respondents 4 to 6 and provide police protection for the Margazhi Pongal celebrations.

ORDER

This writ petition has been filed for issuance of Writ of Mandamus directing the respondents 1 to 3 to conduct enquiry by taking into account the petitioner's compliant dated 18.08.2025 and initiate action against the respondents 4 to 6 and provide police protection for the Margazhi Pongal celebrations.

2. The contention of the petitioner is that the private respondents belong to a particular section of people, while the petitioner belongs to another section. The petitioner and others have a separate temple for themselves, and the private respondents are interfering with the temple of respondents 4 to 6, which belongs to a separate section of people, especially the administration. The land and other properties belong to the temple of the private respondents. 2/5

Considering the facts of the case, this Court is of the considered opinion that if any complaint is submitted before the respondent police, they shall conduct an enquiry and pass appropriate orders within a period of four weeks from the date of receipt of a copy of this order. If any cognizable offence is made out, the same shall be taken note of and appropriate proceedings may be initiated. If the issue is a civil dispute, the respondent police shall not interfere, and the private respondents are at liberty to file a civil suit, if so advised.

4. With these observations, this Petition is disposed of. 17-12-2025 NCC : Yes/No Index : Yes/No Internet : Yes KSA Note : Issue a copy of order on 19.12.2025.
