ORDER : The Court made the following order :- The petitioner / Accused who apprehends arrest in the hands of the respondent police for the offences punishable under Sections 329(4), 75, 296(b), 109, 351(3) of BNS 2023 and Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, in Crime No.979 of 2025 on the file of the respondent police, seeks anticipatory bail,

2. This is the second anticipatory bail application filed before this Court. The case of the prosecution is that due to previous enmity, the petitioner trespassed into the house of the defacto complainant, pulled the hand of the defacto complainant's sister-in-law, attempted to misbehaved with her, assaulted the defacto complainant and his sister, and abused them in filthy language. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He further submitted that there was a land dispute between the defacto complainant and the petitioner's family, a false case has been given. He further submitted that the petitioner is 2/5

ready and willing to abide by any stringent conditions that may be imposed by this Court. Hence, he seeks anticipatory bail.

4. The learned Government Advocate (Criminal Side) submitted that earlier application was dismissed by this Court in Crl.OP(MD).No. 17893 of 2025 dated 28.10.2025 and there is no change of circumstances to allow this petition. Hence,, he objected to grant anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case, and also the fact that there is no change of circumstances in this case and the investigation is at initial stage. If the petitioner is granted anticipatory bail, he may abscond. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.

6.Accordingly, this Criminal Original Petition is dismissed. (S S Y J) 05.01.2026 msrm 3/5
