[Order of the Court was made by G.K.ILANTHIRAIYAN, J.] Seeking to suspend the sentence imposed on the petitioner by the learned Principal District and Sessions Judge, Tenkasi, vide Judgment dated 09.09.2025 in S.C.No.42 of 2024, he has filed this Criminal Miscellaneous Petition.

2. The learned representing counsel represents that the counsel on record is not available and sought time.

3. Heard the learned Additional Public Prosecutor and perused the materials available on record.

4. The petitioner has failed to make out a prima facie case for grant of suspension of sentence and also the petitioner is having very bad

antecedent and he has six previous cases, hence we are of the opinion that it is not a fit case for grant of suspension of sentence to the petitioner.

5. Accordingly this Criminal Miscellaneous Petition stands dismissed.

6. Post the criminal appeal in the usual course for final hearing.
