PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to dispose of the petitioner's application dated 17.06.2025, within a stipulated time period fixed by this Court. ORDER
This Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the official respondents to dispose of the petitioner's application dated 17.06.2025, within a stipulated time period fixed by this Court.
2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.
3. Since no adverse orders are going to be passed against the seventh respondent, notice to the seventh respondent is hereby dispensed with.
4. According to the petitioner, he is the absolute owner of the subject property. During the process of subdivision, Survey Nos.308/16 and 308/17 were wrongly interchanged with those of the adjacent landowner, who is the seventh respondent herein. Hence, the petitioner submitted an application dated 17.06.2025 to the authorities seeking correction of the said error. As the same has not been considered so far, the petitioner has approached this Court by filing the present Writ Petition seeking the relief stated supra.
5. The learned Additional Government Pleader for the respondents 1 to 6 submits that the petitioner's application will be considered on its merits and in accordance with law.
6. Recording the above submission, and without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the second respondent to consider the petitioner's application dated 17.06.2025, on merits and in accordance with law and pass appropriate orders within a period of ten weeks from the date of receipt of a copy of this order. The application shall be considered and disposed of after conducting an enquiry. The second respondent is
directed to provide reasonable opportunity during such enquiry to the petitioner, the seventh respondent and also to the other persons, who may be affected by such decision.
