ORDER

Seeking to quash the impugned FIR in Crime No.225 of 2025 on the file of the first respondent herein, this petition is filed. 2.The petitioner is the wife of the second accused in Crime No.225 of 2025 for the offences under Sections 331(3), 331(4) and 305(a) of BNS, 2023. The case of the prosecution is that the unknown persons broke open the back door of the defacto complainant's house and committed theft of gold jewelry and silver jewelry. The first respondent Police conducted the investigation and recovery has been made by him from both A1 and A2. Based on the confession of A1, the petitioner's name was impleaded as A3. 3.The learned counsel appearing for the petitioner submitted that the petitioner is the wife of the second accused. Despite being a pregnant woman, she has been unnecessarily roped into the criminal case. He further submitted that the petitioner has taken steps to avail a copy of the confession before the learned Trial Court. However, the same was refused. Hence, the present petition has been filed seeking to quash the proceedings. 2/5

4.The learned Government Advocate (Crl. Side) on instructions, submitted that the investigation is not yet completed. Hence, he prays for dismissal of this petition.

5.Heard the learned counsel on either sides and perused the mateials available on records.

6.Since the matter pertains to the alleged theft of gold and silver jewelry, this Court is of the considered view that it is premature to arrive at a conclusion as to whether the case is a fit one for quashing at this stage. Accordingly, the first respondent is directed to expedite the investigation and conclude the same within a period of one month from the date of receipt of a copy of this order. The petitioner is at liberty to raise all the points before the trial Court. 7.With the above directions, this criminal Original Petitio stands disposed of. Consequently, the connected Criminal Miscellaneous Petition is closed.
