ORDER : The Court made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 191(2), 191(3), 296(b), 329(4), 118(1), 324(4), 318(4), 351(3), 303(2) of BNS 2023, in Crime No.551 of 2025 on the file of the respondent police, seek anticipatory bail.
2. The case of the prosecution is that there was some dispute between the petitioners and the defacto complainant, as a result of which, the petitioners have abused the defacto complainant in filthy language and also attacked him, due to which, he sustained injuries. Hence, the complaint.
3. Heard the learned counsel appearing for the petitioners, the learned Government Advocate (Crl.Side) appearing for the respondent police and the learned counsel appearing for the Intervenor/defacto complainant.

4. This Court had previously referred the matter to the Mediation Centre attached to this Bench, and pursuant thereto, the parties have arrived at the following compromise:
(a) The Petitioners of this said Crl.OP(MD).No.22341 of 2025 had agreed to the respondents/defacto complainant to settle the amount of Rs.13,00,000/- involved in this Crime to make good with the loss incurred by him in 3 (three) instalments. In order to comply it, a sum of Rs.5,00,000/- paid to the 2nd respondent/defacto complainant namely Mohan by way of Demand Draft bearing DD No. 00120861321103 dated 02.01.2026.
(b) The petitioners further settled the 2nd instalment as agreed, and paid Rs.4,00,000/- to the 2nd respondent/defacto complainant namely Mohan, by way of Demand Draft bearing D.D.No.001229613211003 dated 28.01.2026. ( c ) The defacto complainant here by agrees to close the further action in Crime No.551 of 2025 on the file of the Orathanadu Police Station, Thanjavur District, on which the said Crl.OP(MD).No.22341 of 2025 was compromised. By accepting the petitioners promise to pay the 3rd and Last installments a sum of Rs.4,00,000/- payable through DD on 18.02.2026 as agreed in the terms of settlements. On 3/7
receiving the same this defacto complainant here by completely agrees to drop action and close the said FIR against the petitioners and also accepting the defacto complainant to return the agreement documents to the petitioners on 18.02.2026.

Considering the facts and circumstances of the case, and noting that the dispute has been amicably settled between the parties before the Mediation and duly recorded, this Court is inclined to grant anticipatory bail to the petitioners, subject to certain conditions.. 6.Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance, on condition that each of the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Orathanadu, within a period of fifteen days from the date on which, the order copy was made ready and on further conditions that:
[a]the petitioners and the sureties shall affix their photographs and left thumb impression in the surety bond 4/7
and the Magistrate may obtain a copy of their Aadhaar card or bank pass book to ensure their identity; [b] the petitioners shall report before the respondent police as and when required;
[c]the petitioners shall not tamper with the evidence or witness either during investigation or trial. [d]the petitioners shall not abscond either during investigation or trial.
[e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioners are released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].
[f]If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of BNS.

7. Further, liberty is granted to the petitioners to file a quash petition based on the settlement arrived at between the parties. The defacto complainant has also undertaken that he will withdraw the complaint, if submitted, and the respondent police have consequently dropped further action.
