PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 2 to 4 to survey and fix boundaries of the petitioner's property in Sy.No.434/1A1 to the extent of 0.12.50 Hectares of Punja Land situated at Melambur Part-I Village, Tenkasi Taluk, Tenkasi District and to give adequate police protection by considering the petitioner's application dated 31.01.2022 and his representation dated 13.11.2025 within a stipulated period as framed by this Court. ORDER

This writ petition has been filed seeking the issuance of a writ of mandamus directing the respondents 2 to 4 to survey and fix the boundaries of the petitioner's property in Sy.No.434/1A1, measuring 0.12.50 hectares of punja land, situated at Melambur Part-I Village, Tenkasi Taluk, Tenkasi District, and to provide adequate police protection, based on the petitioner's application dated 31.01.2022 and his representation dated 13.11.2025, within a time frame to be fixed by this Court.

2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.

3. Since no adverse orders are going to be passed against the respondents 5 and 6, notice to the respondents 5 and 6 is hereby dispensed with.

The learned counsel for the petitioner submits that the petitioner is the owner of the property in Sy.No.434/1A1, measuring 0.12.50 hectares of punja land situated at Melambur Part-I Village, Tenkasi Taluk, Tenkasi District. It is contended that despite the petitioner having submitted an application on 31.01.2022 and a subsequent representation on 13.11.2025, the respondents 2 to 4 have not initiated steps to survey the land or fix its boundaries. The learned counsel further submits that due to obstruction by third parties, the presence of police protection is also required for the smooth conduct of the survey. Therefore, the petitioner seeks a direction to the official respondents to survey and demarcate the property and to provide adequate police protection within a time frame to be fixed by this Court.

5. The learned Special Government Pleader appearing for the respondents 1 to 3 would submit that after consideration of the claims of both the parties, proper steps would be taken to demarcate the land in accordance with Sections 9 and 10 of the Tamil Nadu Survey and Boundaries Act, 1923.

Recording the aforesaid submission, this Court directs the respondents 2 and 3 to consider the representation of the petitioner dated 13.11.2025 and demarcate the land of the petitioner, after consideration of the claims of both the parties and pass orders in accordance with Sections 9 and 10 of the Tamil Nadu Survey and Boundaries Act, 1923, within a period of twelve weeks from the date of receipt of a copy of this order. In the event of any rival claims, the parties are at liberty to work out their remedies before the Civil Court.

7. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
